For what purpose do we process personal data?

 

The personal data of the interested party are processed for the purpose of managing and developing the contracted services.

Likewise, the personal data of the Interested Party may be processed for the following additional purposes, provided that they have been consented by the interested party:

  • Sending information and communication of commercial promotions regarding contracted services and request to participate in opinion polls, for which we will be able to perform purchase profiles and analysis of habits based on the information obtained.
     
  • Transmission of information and communications in relation to the services, activities and promotions of the BSM Group, for which we will be able to create purchase profiles and analyze habits based on the information obtained.
     
  • Photographing and videography during the tour of the "Roller Coaster" and "Mina d'Or" attractions, in order to offer customers a memory of their experience at the attractions.

 

How long will we keep the data?

 

The personal data provided by the Interested Party will be kept as long as the contract concluded between the BSM Interested Party is in force, and once its termination occurs, they will be blocked until the applicable limitation periods have passed.

In the event that you have given your consent to the processing of the data, until the interested party requests its deletion, at which time they will be blocked until the applicable limitation periods have expired.

What authorizes us to process the data?

 

The legal basis for processing the personal data of the Interested Party is the execution of the contract. In this sense, the interested party is obliged to provide the data necessary for its execution. If you do not provide us with this information, it will not be possible to conclude the contract.

Regarding the rest of the treatments, the legal basis is the prior and unequivocal consent of the interested party.

 

To which recipients can we communicate the data?

 

The personal data of the Interested Party may be transferred to the following recipients:

  • Companies of the BSM Group.
  • Public Administrations when so established by an applicable legal provision and Courts and Tribunals.
  • Suppliers who provide services to the BSM Group related to the management of the formalized contract and who have the status of data processors. In any case, the third parties with whom certain personal data of the Interested Party are shared will have previously certified the adoption of appropriate measures for the correct protection of the data.

 

What are the rights of the interested parties in relation to the data they provide us?

 

Anyone has the right to obtain confirmation as to whether we are processing personal data concerning them. Interested persons have the right to access their personal data, as well as to request the rectification of inaccurate data or, where applicable, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which they were collected.

In certain cases, the interested party will have the right to request the limitation of the processing of their data, in which case we will only keep them for the exercise or defense of claims.

In certain circumstances and for reasons related to their particular situation, interested parties may object to the processing of their data. In this case, the entities of the BSM Group before which this right is exercised will stop processing the data, except for compelling legitimate reasons or the exercise or defense of possible claims.

In any of the above cases, the corresponding entity of the BSM Group will communicate any rectification or deletion of personal data, as well as any limitation of treatment carried out, to each of the recipients to whom the personal data has been communicated, unless it is or requires a disproportionate effort. If the Interested Party so requests, the BSM Group entity in question will inform them about the aforementioned recipients.

Likewise, the interested party will have the right to receive the personal data that concerns him and that he has provided to BSM, in a structured, commonly used and machine-readable format, and to transmit them to another person in charge when the treatment is based on consent or in a contract, and is carried out by automated means.

The interested party will have the right to object at any time, for reasons related to their particular situation, to the fact that personal data concerning them are the subject of treatment based on the public or legitimate interest in the BSM Group or a third party , including the creation of profiles, in order for BSM or another entity of the BSM Group to stop processing the personal data, unless they can prove compelling legitimate reasons for the treatment that prevail over the interests, rights and freedoms of the Interested Party, or for the formulation, exercise or defense of claims.

Likewise, the interested party will have the right not to be the subject of a decision based solely on automated processing, including profiling, that produces legal effects or significantly affects him, unless this decision is necessary for the conclusion or execution of a contract with BSM or another entity of the BSM Group and is authorized by current European or state law or is based on the express consent of the Interested Party.

Video surveillance

 

BSM will treat the images captured through the camera and video camera systems (in the recording and real-time viewing modes) in accordance with the following information:

PURPOSE: To preserve the safety and protection of people and goods as well as to preserve the safety and operability of the entity's equipment and facilities.

LEGITIMATION: The legal basis for the processing of images through camera or video camera systems in the institution's facilities is:

The fulfillment of a public interest mission consists in guaranteeing the safety of people, goods and facilities.
The legitimate interest consists in the need for BSM.SA, responsible for the treatment, to establish supervisory measures to verify compliance by workers with their work obligations.
RECIPIENTS: The images may be transferred to the Forces and Security Bodies of the State, as well as to the Courts and Tribunals in compliance with a legal obligation applicable to BSM.SA as the person responsible for the treatment.

CONSERVATION: The images captured through the recording video surveillance camera system will be preserved for a maximum period of one month from their capture. Once the same has passed, they will be deleted, except when they must be kept to prove the commission of acts that threaten the integrity of people, property or facilities.

In the cases in which the camera system used is the one viewed in real time, the images will not be preserved to the extent that no recording or storage of images is carried out.
